Acceptable Use Policy

Applies to: all visitors, registered partners, and users of phaneosAI services, including any agency that resells, integrates, or deploys phaneosAI deliverables for end-clients.

1. Purpose

This policy sets out the rules for using phaneosAI's website, services, and outputs. It supports our obligations under the EU Digital Services Act, GDPR, EU AI Act, Vietnam's Law on Personal Data Protection, and other applicable laws.

2. Prohibited conduct

You may not use phaneosAI services to:

2.1 Illegal and harmful activity

  • Violate any applicable law, regulation, or sanctions regime.
  • Promote, facilitate, or engage in fraud, scams, phishing, malware, ransomware, or hacking.
  • Distribute child sexual abuse material, extremist content, or content that incites violence.
  • Harass, stalk, threaten, or discriminate against individuals or groups.

2.2 Intellectual property and privacy violations

  • Infringe copyright, trademark, trade-secret, patent, or other intellectual property rights.
  • Use personal data without a lawful basis or beyond the scope consented to by data subjects.
  • Circumvent technical protection measures or scrape, crawl, or harvest data from our website without permission.

2.3 Platform abuse

  • Probe, scan, or test the vulnerability of our systems without authorization.
  • Interfere with or disrupt the website, services, or networks connected to them.
  • Use bots, scripts, or automation to register accounts, submit forms, or extract data at scale.
  • Impersonate phaneosAI personnel or misrepresent your affiliation with us.

2.4 AI-specific misuse

  • Generate or distribute deceptive synthetic media intended to defraud, defame, or manipulate political, legal, or commercial outcomes ("deepfakes").
  • Create or distribute hate speech, extremist propaganda, sexually explicit content involving minors, or content that promotes self-harm.
  • Develop or deploy biometric identification, emotion-recognition, or social-scoring systems in contexts prohibited or high-risk under the EU AI Act without explicit written agreement.
  • Use AI outputs to make fully automated decisions that produce legal or similarly significant effects on individuals, unless required safeguards (human-in-the-loop, right to contest, meaningful explanation) are in place.

3. High-risk and restricted use cases

The following uses require a written agreement with phaneosAI and, where applicable, a separate compliance assessment before deployment:

  • Healthcare diagnosis, treatment recommendations, or medical-device software.
  • Credit scoring, lending decisions, insurance underwriting, or other financial eligibility decisions.
  • Employment, hiring, or worker-evaluation systems.
  • Education or vocational testing that affects access to opportunities.
  • Law enforcement, criminal justice, migration, or asylum processing.
  • Biometric identification or real-time remote identification in public spaces.

phaneosAI may decline, suspend, or terminate services for any use case that we reasonably believe creates unacceptable legal, ethical, or reputational risk.

4. Agency and partner responsibilities

If you are an agency or partner integrating phaneosAI outputs into client projects, you are responsible for:

  • ensuring your use and your client's use comply with this policy and all applicable laws;
  • disclosing the role of AI and any human oversight to end-clients;
  • not misrepresenting AI-generated content as human-created where such disclosure is required or materially misleading;
  • indemnifying phaneosAI for breaches caused by you or your clients.

5. Monitoring and enforcement

We reserve the right to:

  • investigate suspected violations;
  • suspend or terminate access without prior notice for serious or repeated violations;
  • remove or disable content or outputs that violate this policy;
  • report illegal activity to the appropriate authorities;
  • cooperate with law enforcement and regulators as required by law.

6. Reporting violations

If you believe a user or partner is violating this policy, email us at hello@phaneos.cloud with a clear description and any supporting evidence.

7. Changes

We may update this policy as laws and risks evolve. The effective date at the top of the page shows the latest revision.
